TBK FOOD TRUCKS

Welcome to TBK Food Trucks (the “Site”). By browsing the Site, requesting a quote, placing an order online,
booking an event, or hiring our catering and food truck services (the “Services”), you (the “Client”) agree to
these Terms and Conditions (the “Terms”). If you do not agree, please do not use the Site or hire our
Services.
1. Identity and Contact Information
TBK Food Trucks is the trade name of The Brother’s Kitchen Grill LLC, based in Homestead, Florida.

2. Definitions
● Event: Provision of Services on-site for a corporate, school, private, or public event.
● Quote: Economic and operational proposal issued by TBK Food Trucks with a limited validity period.
● Deposit: Initial payment required to secure a date and resources.
● COI: Certificate of Insurance, when applicable.
3. Scope of Services
We provide catering and food truck services within the coverage area published on the Site. Dates,
schedules, menus, quantities, and logistics are confirmed in writing through a Service Order or Contract. TBK
Food Trucks may engage approved personnel, suppliers, or subcontractors when necessary to maintain
quality standards and compliance.
4. Booking and Payment Process
4.1 Quotes
All quotes are valid for 72 hours unless otherwise stated and may vary based on availability, supply costs,
fuel, tolls, permits, parking, distance, and other logistical factors.
4.2 Deposit
A 50% deposit of the estimated total is required to secure the date. Without the deposit, the date is not
reserved.
4.3 Final Payment
The remaining 50% balance is due upon completion of the Event unless otherwise agreed in writing.
4.4 Payment Methods
We accept credit and debit cards and electronic payment methods available on the invoice or checkout page.
Late payments may result in administrative fees.
4.5 Taxes
Prices do not include taxes unless otherwise stated. Tax-exempt Clients must provide a valid exemption
certificate before invoicing; otherwise, applicable taxes will be charged.
4.6 Gratuities
Gratuity is not included unless otherwise stated and remains at the Client’s discretion at the end of the Event.
5. Changes, Cancellations, and Refunds
Date or time changes are subject to availability. Cancellations must be made in writing via the contact email.
● 14 or more days before the Event: Deposit refunded minus a 10% administrative fee.

● 7-13 days before the Event: 50% of the deposit is retained.
● Less than 7 days before the Event: 100% of the deposit is retained.
● Same day or no-show: TBK Food Trucks may charge up to 100% of the estimated total to cover costs and
allocations.
If an Event requires permits, parking, security, or access fees that have already been processed, those
amounts are non-refundable.
6. Logistics, Access, and Site Conditions
The Client guarantees:
● Adequate space for the food truck and safe operation.
● Access and internal permissions for private properties, campuses, and venues.
● Designated parking free of obstructions.
● Electricity or water access when previously agreed; otherwise, TBK Food Trucks will bring its own
resources when possible.
● Compliance with applicable noise, schedule, waste, safety, and health requirements.
If TBK Food Trucks cannot operate due to circumstances beyond its control, including denied access,
inadequate space, or missing permits, the situation will be treated as a Client cancellation.
7. COI, Permits, and Safety
TBK Food Trucks maintains required insurance policies and operational licenses. Upon request, a Certificate
of Insurance may be provided with at least 3 business days’ notice. Municipal permits, venue fees, parking
fees, and security costs required by the venue are the Client’s responsibility unless otherwise agreed in
writing.
8. Menu, Substitutions, and Availability
Menus, portion sizes, and service times are detailed in the Service Order. TBK Food Trucks may substitute
ingredients or make adjustments due to seasonality, availability, weather, or food safety concerns while
maintaining comparable quality and value.
Allergen Notice: Products may contain or come into contact with common allergens. The Client must
communicate dietary restrictions in advance. Reasonable accommodation efforts may be made, but an
allergen-free environment cannot be guaranteed.
9. Service Times and Quantities
Service begins and ends at the agreed times. Additional hours, servings, or guests beyond the contracted
amount will be billed at the applicable rate.
10. Weather and Force Majeure
In cases of severe weather or force majeure, including hurricanes, flooding, power outages, government
shutdowns, or emergencies, TBK Food Trucks may reschedule the Event without penalty, subject to
availability. If the Client chooses to cancel instead, the cancellation policy will apply.
11. Site Content, Branding, and Use
All text, images, logos, trademarks, and other content on the Site are the property of TBK Food Trucks or its
licensors and are protected by intellectual property laws. Unauthorized use is prohibited. The Site may
contain third-party links; TBK Food Trucks is not responsible for their content, policies, or availability.
12. Testimonials, Photos, and Image Rights
Unless the Client provides written notice before the Event, TBK Food Trucks may capture and use
photographs or video taken during service for marketing purposes, including on websites, social media, and
portfolios. Clients may opt out by emailing thebrotherskitchengrill@gmail.com before the Event.
13. Communications and Data
By requesting a quote, booking, or making a purchase, the Client authorizes TBK Food Trucks to contact them
by email, phone, or WhatsApp for operational updates, confirmations, reminders, and service feedback.
Marketing communications require separate consent. Data handling is governed by the Privacy Policy
available on the Site.
14. SMS Marketing Terms
By voluntarily opting in, you agree to receive recurring promotional text messages from TBK Food Trucks,
including special offers, catering promotions, and event updates. Message frequency varies. Message and
data rates may apply.
Consent to receive marketing text messages is not a condition of purchasing any product or service or
requesting a quote. You may opt out at any time by replying STOP. For assistance, reply HELP or contact us
through https://www.tbkfoodtrucks.com/. Mobile carriers are not responsible for delayed or undelivered
messages. TBK Food Trucks may modify or discontinue its SMS marketing program at any time.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Florida. For any dispute, the parties agree to submit to
the state and federal courts of Miami-Dade County, Florida, and waive any other jurisdiction that may
otherwise apply.
